Will Smith has filed a motion seeking the dismissal of a sexual harassment lawsuit brought against him by violinist Brian King Joseph.
The lawsuit names Smith and his company, Treyball Studios, as defendants.
Allegations in the Filing
According to the complaint, during Smith’s Las Vegas concert, Joseph returned to his hotel room and discovered a handwritten note reading, “Brian, I’ll be back… just us,” signed “Stone F.”
Joseph also reported finding several items in the room, including wipes, a beer bottle, a red backpack, a single earring, hospital discharge paperwork, and a bottle of HIV medication bearing another individual’s name. The lawsuit asserts that these discoveries caused him concern and emotional distress.
Defence Response
Smith’s legal team disputes any connection between the actor and the alleged incident. The motion to strike highlights that Joseph admits he does not know who “Stone F” is, yet proceeded to name Smith and Treyball Studios in the complaint.
The defence describes the case as a “frivolous lawsuit” and an “attempted money grab,” maintaining that no factual evidence links Smith to the note or the listed items.
Tour Role and Wrongful Termination Claims
The defence also challenges Joseph’s claim that he was promised a permanent role on the tour. According to court filings, Joseph was hired on a per-show basis without any guarantee of continued participation.
Smith’s lawyers further argue that the actor and Joseph were never alone together, disputing allegations of grooming behaviour.
The lawsuit additionally includes a wrongful termination claim, alleging Joseph was removed from the tour after raising concerns about the hotel room incident.
However, Smith’s legal team states that witnesses are prepared to testify that Joseph was not retained due to behaviour described as erratic and disruptive to other band members, rather than any misconduct by Smith.
